A handbook on new administrative procedure published

The handbook provides explanations based on real examples as to key provisions and novelties of the Law of Ukraine "On Administrative Procedure". This law introduces general and transparent rules on how the state is to interact with citizens and businesses.

It will be useful for authorities involved in aligning special legislation with the provisions of the Law, public servants who will do immediate work related to general administrative procedure and everyone who is interested in public administration.

The handbook available at the link:

  • contains many examples from real life that will help you understand how the Law will work in practice;
  • explains a number of key concepts, namely: administrative body, administrative procedure and proceedings; margins of appreciation; the persons concerned, administrative act;
  • considers the mandate of the administrative body, a person's rights and obligations pertaining to the administrative procedure, and requirements for administrative acts;
  • sets forth the general procedure and deadlines for processing cases, making a decision and notifying citizens of it;
  • considers conflicts that may arise between the Law "On Administrative Procedure" and special laws and proposes ways how to resolve them;
  • contains detailed recommendations for various groups of public servants on how to get ready to implement the Law "On Administrative Procedure".

We would like to remind you that the online course "General Administrative Procedure" has recently been released. It deals with the main novelties of the Law. Upon its successful completion, a person gets a certificate and 0.2 ECTS credits.

To get ready to implement the Law, public officials are already taking part in training courses. At such courses, they solve specific cases to understand how the novelties will work in practice.

The notice on the official website of the Ministry of Justice of Ukraine mentions practical benefits of such training and the main purpose of the handbook: "To make sure that a wider audience of public servants can learn the specifics and understand the gist of administrative procedure by using real-life case studies, the handbook "The Law on Administrative Procedure: general and transparent rules of how the state is to interact with citizens and businesses" was published.

On June 13, 2022, Volodymyr Zelenskyi, President of Ukraine signed the Law "On Administrative Procedure". However, it will enter into force on December 15, 2023. Such a significant delay is required because it is necessary to train a large number of public servants and amend some current laws to minimize conflict of laws.

Adopting the Law "On Administrative Procedure" is a new stage in how executive and local self-government bodies will interact with citizens and businesses. Its implementation brings Ukraine closer to the European Union standards because similar laws operate in all EU Member States as an integral part of the right to good governance.

The handbook was drawn up with the support of the European Union via EU Project "Support to comprehensive public administration reform in Ukraine" (EU4PAR) with the support of the Ministry of Justice of Ukraine and the Office of Reforms of the Cabinet of Ministers of Ukraine upon request of the Secretariat of the Cabinet of Ministers of Ukraine.
