EU Project Pravo-Justice and the National School of Judges have developed training on the Law of Ukraine on Administrative Procedure

EU Project Pravo-Justice and the National School of Judges of Ukraine have developed training “The Law of Ukraine on Administrative Procedure and its impact on administrative proceedings.” The training will complement the standard curriculum of the National School of Judges of Ukraine (NSJU) for training administrative court judges.

For the first time, the training was conducted by EU Project Pravo-Justice and NSJU as part of competency management training for judges of appellate administrative courts on November 18, 2022.

“In the 18 months given by the legislator to prepare for the entry into force of the Law on Administrative Procedure, it is of utmost importance to ensure that all preparatory steps for its effective implementation are taken. An integral element of such a preparation is training judges and civil servants on the novelties set forth in the Law. Today, we can say that NSJU is ready for this it terms of quality and has already started training judges within standard training of administrative court judges”, noted Oksana Tsymbrivska, Country Manager of EU Project Pravo-Justice.

Mykola Onishchuk drew the attention of the training attendants to the events held by the National School of Judges of Ukraine and preserving judicial education skills in wartime. The rector emphasized that almost from the first days of the war, NSJU has served as a platform for a broad inter-judge dialogue.

The first training was designed and delivered by Olesia Radyshevska, Olena Hubska, and Serhii Ukhanenko, justices of the Cassation Administrative Court within the Supreme Court; Oleksandr Sytnykov, retired justice of the Supreme Administrative Court of Ukraine; Viktor Tymoshchuk, senior researcher of the Koretskyi Institute of State and Law of the National Academy of Sciences of Ukraine, Deputy Chair of the Board of the Centre for Political and Legal Reforms, Ph.D. in law, EU Project Pravo-Justice national expert.

The training curriculum is focused on the novelties of the Law of Ukraine on Administrative Procedure. The main topics cover the subject of the new Law, where it fits in the regulatory framework, the terms and principles of the Law, the functions of the administrative body, the definition of the participants in the proceedings and of the persons contributing to case consideration, practical issues of initiating and preparing to consider an administrative case, its consideration and resolution, the concept of an administrative act, the procedure for notification, administrative appeals, revocation and invalidation of an administrative act, and enforcement of an administrative act.

The training format provides opportunities to actively involve participants in discussing conflicts of laws and doing case studies. EU Project Pravo-Justice provides comprehensive support to shaping a common understanding of the novelties of the Law on Administrative Procedure among judges and their timely and high-quality preparation before the Law enters into force in December 2023. The further step is training for assistant judges planned for December 9, 2022.
