EU Project “Pravo-Justice” supported a legal event on registering rights to land plots

On 30 June, EU Project “Pravo-Justice” supported a legal event “Certain aspects of state registration of property rights to agricultural land plots for farming and municipal property. Registering property rights of farm founders. Remedies for infringed rights”. The event was initiated by the Southern Interregional Department of the Ministry of Justice of Ukraine. The event was attended by representatives of the Dnipro Regional Council, the Ministry of Justice of Ukraine, Administrative and territorial communities, notaries, state registrars, lawyers, and academia.

“Ukraine has the largest bank of agricultural land in Europe. Two years ago, the country launched one of its most ambitious reforms, liberalising its agricultural land market and lifting one of the most seemingly unyielding moratoriums on agricultural land transactions. The amendments to the Land Code adopted by the Parliament of Ukraine were intended to establish transparent land management, facilitate investment activity, improve registers and ensure the quality of data therein, simplify access to credit, and boost financial markets, etc. This reform involves a huge number of tasks, which have only expanded because of Russia’s full-scale military aggression. All of them need to be discussed, evaluated and joint professional responses should be worked out. Therefore, such discussions are extremely important for EU Project “Pravo-Justice” which works in the field of property rights protection,” said Iryna Zharonkina, Property Rights and Enforcement Component Lead, EU Project “Pravo-Justice”.

At the event, Oleh Mykhaliuk, Key National Expert of EU Project “Pravo-Justice”, presented an analytical report on the status of enforcement of court decisions imposing obligations against the state. This report was drafted by EU Project “Pravo-Justice” experts at the request of the Ministry of Justice of Ukraine.

“In Ukraine, inefficient enforcement of court decisions has become a systemic problem. This problem is most noticeable in the area of enforcing court decisions imposing obligations on the state and local self-government authorities. Despite the fact that enforcing such court decisions does not require extra budgetary expenditures, their enforcement in practice is accompanied by many obstacles. Currently, state enforcement officers do not have effective tools to ensure the effective enforcement of this category of court decisions,” said Oleh Mykhaliuk. He said that the recommendations proposed in the report include ensuring equal mandates for public and private enforcement officers; fostering a culture of enforcement of court decisions; introducing effective personal financial sanctions against persons who directly or indirectly obstruct the enforcement of a court decision, including members of collegial bodies. The legal event was divided into three sections:

  1. Land legal relations in the field of state registration;
  2. Land legal relations in the field of notary;
  3. Mechanisms of human rights protection in the field of land relations.

Based on the findings of the legal event, proposals will be drafted to the Ministry of Justice of Ukraine and the Parliament of Ukraine to be taken into account in further law-making activities.
